Roost Terms of Service

What changed in this version: Section 5 now defines objectionable content and sets out how we remove content and act on reports, and Section 6 covers morning quest photos, Owly's AI-generated comments, and what you are responsible for when you take a photo.

These Terms of Service ("Terms") are a binding agreement between you and TC Fusion LLC ("TC Fusion," "we," "us," or "our") governing your use of the Roost mobile application and related services (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use Roost. By using the Service you represent that you meet this requirement and that you are able to enter into a binding contract (or, where permitted by local law, that you have the consent of a parent or guardian who agrees to these Terms on your behalf).

2. The Service

Roost is a gamified, social sleep app. With your permission, it reads sleep data from Apple Health or Android Health Connect (or accepts manual entry) to compute habit-building progress — Sleep Points, ranks, streaks, and quests — that you climb alongside a small "roost" of other users. Some features are free; others require a paid subscription (see Section 7). We may add, change, or remove features over time.

Roost also includes an optional morning quest: you can take one photo a day with the in-app camera, our mascot Owly writes a short automated comment about it, and you can choose to share the photo with a roost you belong to. Roost has no public feed, no discovery, and no direct messages. Sections 5 and 6 govern this and any other content you provide.

Roost is a consumer wellness and habit-building app. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Sleep figures, scores, ranks, and insights are estimates derived from consumer sensors and are provided for general informational and motivational purposes only. They are not a substitute for professional medical advice. Always consult a qualified healthcare provider with any questions about your sleep or health, and never disregard or delay seeking medical advice because of something in Roost. If you think you may have a medical emergency, contact your doctor or emergency services immediately. Do not make medication, treatment, or other health decisions based on the Service.

What counts as objectionable content

"Objectionable content" means any content you upload, share, or transmit through the Service, including a morning quest photo, profile photo, display name, or owl name, that:

This list describes the kinds of content we prohibit. It is not exhaustive, and we may treat content as objectionable even if it is not specifically listed.

Reporting, removal, and enforcement

There is zero tolerance for objectionable content or abusive behaviour. You can report a shared morning quest photo directly from the photo, and you can report a member's profile photo, display name, owl name, or conduct from their profile. You can also block any member at any time, which makes your content and theirs mutually invisible and stops interactions between you.

To report content or conduct, use the in-app report action or contact us at privacy@tcfusion.dev. If you believe your content was removed in error, reply to that address and a person will review it.

6. Your content & photos

You may provide content such as a display name, an owl name, a profile photo, and morning quest photos ("Your Content"). You retain ownership of Your Content. You grant TC Fusion a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, resizing or compressing an image), and display Your Content solely to operate and provide the Service. That includes showing your display name and avatar to members of your roost, showing a morning quest photo to the roost you chose to share it with, processing a photo as described below, and reviewing content that is reported. This license ends when you delete the content or your account, except for copies we must keep for the moderation and legal purposes described in these Terms and the Privacy Policy.

We do not sell Your Content, use it for advertising, or use it to train artificial-intelligence models, and we do not permit our service providers to do so.

Morning quest photos

Morning quest photos are private to you unless you choose to share them with a roost, and a shared photo is visible to that roost for 7 days. How long we keep photos, and how you delete them, is explained in Section 5 of the Privacy Policy. When you take a morning quest photo, you confirm that:

Your morning quest photo is not a backup. Do not rely on Roost as the only place a photo exists. Photos are deleted on the schedule set out in the Privacy Policy, and we may remove content in line with Section 5.

Owly's comments and automated processing

When you take a morning quest photo, the photo and the name of the quest are sent to a third-party artificial-intelligence provider so it can generate Owly's one-sentence comment and screen the photo for objectionable content. The provider is identified in the Privacy Policy, which also sets out exactly what is sent. By using the morning quest, you agree to this processing. If you would rather it not happen, do not use the morning quest. The rest of the Service works without it.

Owly's comments are automatically generated, are meant as light-hearted flavour, and may be inaccurate, odd, or wrong about what is in your photo. They are not advice of any kind, and nothing Owly says is a statement by TC Fusion about you or your photo. Owly's comments and the Roost characters, artwork, and other material we provide remain ours under Section 8.

7. Subscriptions & billing

Roost offers an optional paid subscription ("Roost Premium"), available on a monthly or annual basis, and may offer a free trial. Pricing is shown in the app before you purchase.

Consistent with our design, Roost does not sell "streak freezes" or any paid way to avoid losing progress. Premium adds optional features; it never charges you to undo a missed night.

8. Intellectual property

The Service, including its software, design, text, graphics, the Roost name, the Owly character, logos, and other content we provide (excluding Your Content), is owned by TC Fusion or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.

9. Third-party services

The Service integrates with third-party services such as Apple Health, Android Health Connect, Apple and Google sign-in, the app stores, and the artificial-intelligence provider that generates Owly's comments and screens morning quest photos. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. The Service may also depend on your device, operating system, and internet connection, which are your responsibility.

10. Privacy

Our Privacy Policy explains how we handle your personal data, including how your sleep and health data is processed. By using the Service, you acknowledge the Privacy Policy. Health-data processing is based on your explicit consent, which you can withdraw at any time.

11. Termination

You may stop using the Service at any time and can delete your account in the app (Profile → Delete account), which permanently erases your account data as described in the Privacy Policy. We may remove your content, and suspend or terminate your access, if you violate these Terms (see Section 5), if required by law, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

16. Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. Subject to Section 15 (which preserves consumers' rights to their home courts and laws), you agree that any dispute relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

We may update these Terms as the Service evolves. When changes are material, we will update the "Last updated" date and, where appropriate, notify you in the app. By continuing to use the Service after changes take effect, you accept the revised Terms. If you do not agree, stop using the Service and delete your account.

These Terms, together with the Privacy Policy, are the entire agreement between you and TC Fusion regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect.
